Uber and Lyft operate differently from traditional transportation companies—they classify their drivers as independent contractors, not employees. This means they often try to avoid direct liability when accidents happen. However, both companies do provide insurance coverage in specific situations, depending on the driver’s status at the time of the crash.

When Does Uber or Lyft Provide Coverage?

The amount of coverage available depends on whether the rideshare app was turned on and whether the driver had an active ride request.

No Coverage The App is Off

If the Uber/Lyft driver does not have the app turned on, Uber and Lyft do not cover any damages caused by that driver. If you are involved in an accident with a rideshare driver who does not have the app turned on at the time of the collision, you may seek compensation by filing a normal car accident claim against the at-fault driver’s personal auto insurance provider.

Partial Coverage The App is On, No Passenger Yet

When the rideshare driver has the app turned on but has not yet accepted a ride, Uber and Lyft will cover up to $50,000 per person and up to $100,000 total per accident in bodily injury. If you were hit in your own vehicle by an Uber or Lyft driver who had the app on but did not have a passenger, this coverage may apply.

Full Coverage The App is On, Ride Accepted

When the Uber or Lyft driver has the app turned on and has accepted a ride, Uber and Lyft will cover up to $1 million in damages for an accident caused by the rideshare driver. This includes any period in which the driver has accepted a ride and is on the way to pick up the passenger or has the passenger in the vehicle until drop-off.
